The Lie That Broke Israel's Back By Steve Apfel

Israel now has a quasi-state to contend with. "A victory for the values of truth," exclaimed Sudan's U.N. diplomat after the General Assembly voted to admit Palestine as a non-member observer.

It's a victory for the Palestinian camp, perhaps, but in truth it was a defeat -- of historic proportions. Recalling one thing and reaffirming another, the resolution the GA voted on was packed with lies. Most were blatant. One lie -- you could say the catchphrase of the Palestinian perpetual show -- enjoyed the sanctity of accepted wisdom.

"The Palestinian territory occupied since 1967" appeared, in one form or another, some dozen times in the U.N. resolution. This whopper of an old lie, told so often and for so long as to merge fantasy with reality, made Israel's defeat at the U.N. a long time coming. One might say that it made Israel's defeat historically inevitable.

"Occupied Palestinian Territory" (OPT) is a thing of smoke and mirrors. Historically, it never happened; legally, there never was Palestinian territory for Israel to occupy. Israel took the territories from Egypt and Jordan in 1967, and there's no getting away from that. So today Israel has more right than Jordan to be occupying the West Bank, and more right than Egypt to be occupying Gaza (if Israel's blockade may be called occupation). "Palestine" never enters the equation. Turn Middle East wars and laws upside-down and any way you like, but if the territories belong to any U.N. member, or quasi-member, they belong to Israel.

Not even the famous U.N. Resolution 242 can help. It told Israel to withdraw from territories once held by Jordan, illegally, and Egypt, and it envisaged those territories' return to those two countries. "Palestine" never got a mention in Resolution 242 -- for a couple of good reasons.

Palestinians were not among the belligerents involved in the Six-Day War. Anyway, the people who were going to stake claim to a nation they would call Palestine were a year away from being born.

More than anyone, King Hussein of Jordan understood perfectly that a cart before the horse never gets off the blocks. So he told the 1988 Arab League summit in Amman: "The appearance of a distinct Palestinian national personality comes as an answer to Israel's claim that Palestine is Jewish."

The Hashemite monarch was explaining to fellow potentates why a Palestinian nation had to be conceived in 1968. If it were not, then the West Bank and Gaza would be Israel's by dint of war and law. Arab armies had been vanquished in six days, the territories lost to Israel. That made it imperative for the PLO to revise its covenant, which it did on July 17, 1968. The PLO meddled with Article 24, erasing the old declaration that the West Bank and Gaza were not occupied and now insisting that they were. With that sleight-of-hand, a newborn nation came into the world -- with a newborn bastard illegal occupier.

Armed with nothing but chutzpah, the PLO lost no time cementing the lie that the Jewish state had usurped the foundling's heritage. From there to the accepted wisdom of "Occupied Palestinian Territories" took no more than a quick step.

For all that, "Palestinian territory occupied by Israel" is more than a risible lie of history. It has had the power to alter history. For one thing, the international community took to the idea. For another, a goodly proportion of American, and even Israeli, Jews nailed their colors to that mast. For a third, an economic bubble has OPT to thank. Monthly pay slips for untold hundreds of U.N. staffers depend on that fallacious real estate. Hundreds of NGOs and staffers would be the poorer without it. And remember, OPT is the article of faith on which anti-Zionists peg their zeal. Their god demands little: hate Zionism and revere OPT. Hence the daily invocations. Label products from "occupied territories." Boycott Israel and divest because of OPT.

Then there is the U.N. and its dependency on OPT. Some U.N. organs were custom-made for it -- embedded the fabled territory in their names. One of those organs has a bona fide legal expert at the helm, sporting a grand title but no salary, for he plays the part out of conviction. And what is that conviction but the creed of the anti-Zionist faithful, the "Israel may not be found innocent" creed? It's right there in this U.N. lawman's sonorous title: "Special Rapporteur to the UN Council on Human Rights on violation of Human Rights and International Humanitarian Law in the Occupied Palestinian Territory."

So Israeli crimes are pre-supposed, and the U.N. lawman tours a land of the U.N.'s own making to look for them.

But for the OPT whopper, the world would be a quieter place. And Israel with its settlement enterprise would not now be under U.N.-complicit threat.

The legal impossibility of limited Palestinian statehood at the U.N.

On Thursday, the Palestinian Authority (PA) will again seek statehood at the United Nations. While this form of “statehood” will not confer U.N.member state status to the “Palestinian entity,” it could fundamentally reshape the Middle East, undermine international law, inhibit peace, and violate Israel’s right to exist.

The resolution that the PA submitted to the U.N. General Assembly includes numerous demands that far exceed a simple (but equally illegal) grant of non-member observer state status, i.e. statehood, to the Palestinian Authority.

The ACLJ has put together a comprehensive legal analysis of the fallacies, overreaching and illegality of the PA’s resolution at the U.N.

First, the PA is demanding that the U.N. create the state of Palestine, “on the Palestinian Territory occupied [by Israel] since 1967” within “the pre-1967 borders.”

It is important to understand that historically and factually the PA’s resolution is inaccurate. Israel does not “occupy” Palestinian land; at best, that territory is in dispute, but legally not “occupied.” As ACLJ Senior Counsel Skip Ash in our legal analysis:

At no time in history has there been an Arab Palestinian state or similar Arab Palestinian political entity exercising any form of national sovereignty over either parcel of land. After the British departed Palestine in May 1948, Jewish Palestinians declared their independence, thereby establishing the State of Israel. Israel’s Arab neighbors immediately attacked the fledgling Jewish state. Rather than annihilate the infant state of Israel, Israel actually gained additional territory than originally allotted to it by the UN Partition Plan. The war ended with a series of armistice agreements that, at Arab insistence, determined that the armistice lines were not lawful borders, meaning that actual borders must still be negotiated.

In fact, the areas in dispute were never governed by an Arab Palestinian political entity, as none was established in 1949; “the Jordanian army occupied the West Bank, and the Egyptian army occupied the Gaza Strip.” Israel captured this territory when it was attacked in 1967. The U.N., inSecurity Council Resolution 242, never intended for all of this territory to be returned to Egyptian or Jordanian control.

As our legal analysis explains, the resolution, “only required that Israel return ‘territories’ captured during the 1967 war, not ‘the’ or ‘all the’ territories it captured. Such wording was intentional.”

Second, the PA is demanding that the UN grant something that it has no power or authority under international law to do, statehood.

The U.N. recognizes this principle of international law itself, stating:

The recognition of a new State or Government is an act that only other States and Governments may grant or withhold . . . The United Nations is neither a State nor a Government, and therefore does not possess any authority to recognize either a State or a Government. As an organization of independent States, it may admit a new State to its membership or accept the credentials of the representatives of a new Government.

As we explain:

Thus, existence as a “state” is an a priori requirement for UN membership, and the UN realizes that it does not have the power to recognize a state. Instead, any determination of statehood by the General Assembly would be a raw exercise of politics, not law. As such, any state recognition by the General Assembly would be illegitimate, as would be the “state” so recognized.

For international law purposes, the Montevideo Convention contains the “best-known formulation of the basic criteria for statehood,” to wit, to be a “state,” an entity must possess a permanent population, a defined territory, a government, and a capacity to enter relations with other states. These criteria are widely considered to be the prime indicia of statehood, and the Palestinians’ failure to meet a number of them absolutely preclude any legitimate claim to statehood by the Palestinian Authority.

The Palestinians’ unwillingness to negotiate a defined territory with Israel, and the competing authority of Hamas in the Gaza Strip and the PA in the West Bank, “confirm the fact that the Palestinians lack the territorial control and governmental capacity that is required for statehood or sovereignty.”

This attempt at the U.N. to create a new state, “subverts international law,” and “[c]onsequently, any General Assembly recognition is a legal nullity.”

Third, the PA resolution accuses Israel of illegally obtaining the disputed territories through an aggressive war. Again, this accusation is devoid of factual or legal support.

It is well-settled that international law forbids acquiring territory through aggressive war. The issue is whether territory can be obtained through defensive measures. In effect, when a state violates international law by engaging in aggressive war and that state loses territory it occupies, there is no requirement in international law that such territory be returned to the violating state. In fact, any asserted requirement to do so would reward the aggressor vis-à-vis the victim. As such, Israel reasonably believes that territory may indeed be acquired through defensive measures.

As explained above, the territories in dispute were obtained by Israel in 1967 during the Six Day War and were not the result of an aggressive war by Israel. Thus, Israel is in complete compliance with international law, and “negotiations between the parties are necessary to determine to whom the various territories belong.”

Fourth, the PA is demanding statehood and the acquisition of territory controlled by Israel as a pre-condition to negotiations for a peace agreement with Israel. Essentially, the PA is demanding that negotiations begin from their best-case scenario after throwing out all previous agreements. The ACLJ’s legal analysis concludes:

By attempting to obtain a declaration of statehood via the UN, the PA is in direct violation of a series of Israeli-Palestinian agreements that require bilateral negotiations. By taking its case directly to the General Assembly, the PA is openly and notoriously breaching its treaty obligations with Israel, obligations it freely assumed under the auspices of the international community. For example, Palestinian officials explicitly agreed not to change the PA’s status outside of peace talks pursuant to the Interim Agreements. By appealing to the UN instead of negotiating, the PA is undermining all of the UN’s efforts for peace to date. Were the General Assembly to recognize a form of Palestinian statehood via a status change, the UN would simply undermine its own legitimacy in the international community.

Legally, the PA’s willingness to breach its solemn agreements with Israel by seeking a unilateral declaration of statehood at the U.N. frees Israel “from fulfilling its reciprocal obligations under the same agreements.”

It would “likely trigger a strong Israeli response that could derail indefinitely the achieving of peace between Israelis and Palestinians as well as the establishment of an Arab Palestinian state.”

Finally, the PA resolution at the U.N. relies on bits and pieces of select U.N. resolutions for support, ignoring others and obfuscating their context. Not only did Arab Palestinians reject the principles laid out for the creation of two states in 1947, while Jewish Palestinians accepted them, Arabs immediately attacked the new Israeli state and there has been a perpetual state of conflict ever since. One need only be reminded of the Palestinian rockets that rained down on Israeli civilians a little over a week ago.

Palestinians continue to ignore those same U.N. resolutions’ calls for recognizing Israel as a Jewish state. As our analysis concluded, “In citing General Assembly Resolution 181 and Security Council Resolution 242 as support for the Palestinian claim of statehood status, the Palestinian Authority demonstrates their propensity to pick and choose from UN resolutions those portions that support their asserted claims while simply ignoring portions that undermine their positions.”

Thursday’s vote marks an attempt to fundamentally reshape the Middle East at the expense of international law, peace, and the Israeli and Palestinian peoples. Even if it were to pass the General Assembly, its legal effect would be a nullity.

A propos of the Obama’s Administration’s abandonment of the Mubarak’s regime in Egypt and Obama’s support of the Muslim Brotherhood, Prime Minister Netanyahu’s insistence that the creation of a Palestinian state be accompanied by international guarantees for Israel’s safety rings all the more pathetic. But this prompts me to enlarge on a 1993 paper of Americans for a Safe Israel (AFSI): “AMERICA’S FAILURE to HONOR ITS GUARANTEES.”

The paper appeared under the name of the eminent American philanthropist Dr. Irving Moscowitz and it raised the issue, “Should America Guarantee Israel's Safety?” Given, however, Obama’s pro-Muslim mentality in general, and his support of the Palestinian Authority in particular, it may now be more appropriate to raise, not the question of whether Team Obama should guarantee Israel’s safety, but whether it is objectively committed to Israel’s destruction?

In any event, ponder the AFSI article on American guarantees, originally prepared for publication by Helen Freedman, AFSI’s Executive Director. Then consider my Epilogue.


December 1957. Under Eisenhower, an Aide Memoire was given to Israeli Ambassador Abba Eban by Secretary of State John Foster Dulles: “U.S. would use its best efforts to help assure that a UN force placed in Gaza would prevent that region from continuing to serve as a source of armed infiltration” of Israel. The U.S. GUARANTEED ISRAEL'S RIGHT TO FREE PASAGE THROUGH THE STRAITS OF TIRAN.

  1. President John F. Kennedy affirmed the U.S. commitment.

May 17, 1967. NASSER ORDERED THE UN EMERGENCY FORCE TO VACATE GAZA & the SINAI. They left. Egyptian troops began pouring into the Sinai, leading to the Six Day War.

August 7, 1970. The Nixon Administration diplomacy resulted in a ceasefire in Egypt’s War of Attrition against Israel. THE AGREEMENT INCLUDED U.S. ASSURANCES TO MAINTAIN THE CEASEFIRE. Egypt immediately broke the ceasefire. THE U.S. FAILED TO INTERVENE. Israel was pressed into more negotiations. The Egyptians moved their missiles, which were used against Israel in the 1973 Yom Kippur war.


March, 1988. Secretary of State Schultz met ILLEGALLY with the PLO.

December 14, 1988. Arafat announced his agreement to the conditions for recognition. President REAGAN Declared the 1975 promise NULL AND VOID. Nevertheless, the State Department IGNORED, EXCUSED, AVOIDED RECOGNITION OF CONTINUED PLO TERRORISM.

July 6, 1989. A PLO terrorist steered an Israeli bus off a cliff. The Bush Administration looked away. The whitewashing continues throughout massive terrorism by the PLO under the Bush and Clinton administrations.


March, 1978. Israel retaliated against terrorists in Southern Lebanon and occupied a narrow strip of territory. Carter coaxed Israelis OUT and replaced them with the UN Interim Force in Lebanon (UNIFIL) whose purpose was to protect Israelis from terrorists.

June 1978. 300 PLO terrorists REOCCUPIED UNIFIL controlled areas. UNIFIL aided the terrorists with intelligence information against Israel, and exhibited direct collaboration with the PLO. Terrorism flourished. Israel couldn't retaliate for fear of endangering UNIFIL troops. The Dutch, Irish, Norwegian, French, Swedish, and Nepalese were all collaborators with the PLO.

October 1983. 242 Marines killed in their barracks by a suicide bomber. THE MARINES LEAVE LEBANON.

September 13, 1993. OSLO "PEACE" ACCORDS signed — VIOLATED; OSLO II Accord signed. — VIOLATED

January 1997. Hebron Accord with GUARANTEES by Secretary of State Warren Christopher and Middle East Envoy Dennis Ross — VIOLATED

● Former Senator Alfonse M. D'Amato — 1993: “If Arabs really want peace, why does Israel need ‘protection’ against them?”

● Senator Jackson, Dec. 18, 1973: “Much of the history of international guarantees is the history of countries who have lost their territory, their freedom, and even their sons and daughters.”

● Abba Eban—1956: “A security guarantee is no substitute for defensive strength.”

● Secretary of Defense Robert McNamara and the Joint Chiefs of Staff —1967: “Israel must hold the commanding terrain east of the pre-1967 boundary. To provide a defense in depth, Israel would need a strip about 15 miles on the Golan” — an area even larger than that which Israel currently holds."


Was Benjamin Netanyahu serious when he insisted that creation of a Palestinian state must be accompanied by international guarantees for Israel’s safety? Or was he playing the “Politics-for-Peace Game,” as did his predecessors since Oslo 13, 1993—thus trifling with the lives of the people of Israel (who have suffered more than 15,000 casualties since that Day of Infamy)?

Why be tepid in declaring your sovereignty? Finally, state your case on Jerusalem with a total campaign and also for what G-d gave us and the UNazis can't take away.

Then there are 5 Arab wars and 2 Intifadas lost to the Jews and the relationship of the Mufti of Jerusalem with Hitler that allowed the Holocaust, the Arabs cowardly deny. There is nothing to discuss to give anything back on any level. We paid for it all with Jewish blood, over and over again.

  3. This land was also validated to the Jews with the League of Nations in the 1920s and signed by all those countries doing their doublecross with the UNazis in 2012, that existed at that time. Britain reneged and is part of the problem and has led to this crisis.

Ironically, only a few days ago an article in the Sun-Sentinel was focused on a small group of Israelis opposed to 'circumcision', which goes back to Abraham and our "Covenant with G-d". for thousands of years.

The secular seem to feel that the less Jewish they are on every level, that they will somehow survive, while collaborating with the same forces who want us all dead. Why do I use "UNazis"?

In 2009, in Geneva, when we were there to oppose the Jew-hating 'Durban II', I stood at the entrance to the UN with my large sign that said:"UNazis". I was there for 20 minutes but saw how upset these delegates were in my labeling them who they really were. By then the Swiss police came to confiscate my sign. But I knew that I was on target in branding them who they really are. Resistance is my mantra, not capitulation and fear.

This was repeated by us in NY at the UN, again in 2011, in Sept. for their gathering. Our large sign read: "MOVE UNAZIS TO GAZA" and we kept shouting that the 'flotilla' was leaving at 3.P.M. and they should be on it. We were amazed at how much support we had even from workers at the UN over a 3 day period and much media attention as well. Among those absent was the U.S. Ambassador to the UN, Susan Rice, betraying the Benghazi terrorist attack with Obama's narrative of getting Osama and Al Qaeda is on the run, which is again a pack of lies, while Al Qaeda is expanding everywhere.

We did several demos agains the 'Little Hitler' from Iran, who got much support at the UN, but when you appeared this year, many chose to ignore you about Iran and its nukes, that will only come back to haunt everyone.

Why is the UN in the US? This is a major campaign that would focus on foreign policy that was ignored in this last election cycle except by us, who took this to the GOP and Dem. conventions; to the Veep debate in Ky; Pres. debates in NY and Fla. and a dozen other major events. We even made up 1000 'Romney Supports Israel' bumper stickers to offset not having anything from his campaign at four rallies we were at with our signs and banners. ("Fight Terrorism, Support Israel"), among our many positive statements and much grassroots support.

I want to say that we took on Pope John Paul II when he was in Israel in 2000 and got 80 media. We wanted the Vatican to open its archives on its role in the Holocaust as well as supporting a united Jerusalem and Israel. Whereever we have been, the public is with us. If we show up, they do too. We know better than any group in the world how the grassroots feels about Israel and there is much support, but questions abound as to why Israel keeps playing all these mistakes that aren't necessary.

We've done 20 rallies at the White House including every time you have been there and the ONLY Jewish group to do so.

We've taken on the 14 Jewish groups who met with Obama to divide Jerusalem and sell it to the Jewish people, who aren't buying.

We've opposed the Left and the radical Muslims and have won each and every time with our statements. We have shown the community at large that we aren't afraid, aren't intimidated, aren't going to give in or give up and we are on the offense on who we are and every part of where we have come from. We are Jews, Christians and others who believe in Israel. If Israel will only believe in itself.

We helped get nearly 40% of the Jews to vote against Obama and I am a Democrat who supported Romney, but was very disappointed in his campaign, staff, complacency and indifference to dealing with foreign policy which would have made a difference. But he wouldn't even fight against the misrepresentation of who he is, which sounds familiar as to how Israel needs to go on the offense and stop taking propaganda for granted in this war you are losing.

It is time for being dynamic on every level and with Iran almost with its nukes that Obama is allowing, we must think ahead.

With the global economy, many tensions and blaming Israel and Jews for all the turmoil and in 2012-2013, "Never Again" is happening "Again."

How can we help you to help yourself and save Israel, America and this planet from itself and very little time left to do it?

Bibi, listening only to those with the money they want to donate is why we are in this mess again. You need voices like ours to make this difference.

You don't need a chart at the UN. You need the Torah and point to the very paragraphs where G-d says the Tribes of Israel are supposed to be. When the earthquake happened in Haiti, that killed 300,000+ and Israel came to the rescue and helped save 100,000 lives, where was this campaign then and now to show that you do care.... while the Arabs, including Saudi Arabia, were AWOL and all talk and no monies or action?

How could Haiti vote with the Islamic Nazis and not Israel?

I've had to repeat these issues several times to better understand what the battle is all about.

We are visible all the time with these statements and we have answers that our enemies can't and won't respond to including on the Left.

If the miracle of Chanukah is oil lasting 8 days instead of one, then this needs to be on the public's mind as to who we are as Jews and Israelis and why we are still here celebrating, which is our strength and "Covenant", we can never abandon or we are lost.

Why haven't we heard from you when we are your best ally?

Why are we taken for granted?

Writing you a check isn't as important as being in the streets and with the real grassroots who let us know right upfront if we are right or wrong.

Meet The Author Over Lunch: Maj Jong: The Tiles That Bind!

Beth Moshe Congregation's Meet the Author Jewish Book Series continues on Wednesday, January 9, at 11 a.m. in the Bloch Family Lobby with Shirley Kahn, docent of the Jewish Museum will discuss the history and future of Jewish women’s favorite game Mah Jong.

And award-winning film "Mah Jong: The Tiles That Bind" is a light-hearted yet deeply moving portrait of the Asian- and Jewish-American women who play this centuries-old Chinese game, shedding light on the common and uncommon experiences of the players that simultaneously define and transcend cultural boundaries. Along the way, it proves again and again to be a bridge connecting seemingly unlike individuals, spanning generations, continents and cultures, and transcending classification as merely a game.

The Meet The Author program is a Beth Moshe and Sisterhood of Beth Moshe event and takes place each second Wednesday of the month.

Lehrman Holds Hop, Skip and Jump, Workshop on Literacy and Transition to Elementary School

Lehrman Community Day Holds its third annual Hop Skip and a Jump Event on Sunday January 6th for parents interested in learning about preparing their students for life in early elementary school. The event addresses issues of literacy in pre-school and beyond, developmental markers for reading and especially how best to prepare pre-schoolers and young children for 'the big show.' Dr. Lilia DiBello, Associate Professor of Education and Director of the Department of Curriculum and Instruction at Barry University's School of Education will speak. Dr. DiBello is a recognized authority on child development and literacy. Lehrman teachers will also be on hand to introduce the school's kindergarten, Core Knowledge and Jewish studies/Hebrew curricula. Hebrew Academy Hosts First Hebrew Honor Society Induction

The Hebrew Academy (Rabbi Alexander S. Gross) will hold its first Alef Hebrew Honor Society Induction Ceremony, on Thursday, January 3, 2013, at 2:00 pm, in the Schwartz-Jacobs Campus Auditorium located at 2400 Pine Tree Drive in Miami Beach. Twenty-five students will be inducted to the Honor Society and Mr. Robert Schwartz, Founder of the Southeast Region of the American Friends of Magen David Adom (MDA), will be highlighted as a special guest speaker during the event. Since its founding in 1980 this region has raised more than $110 million for MDA (Israel's national emergency medical, disaster, ambulance and blood bank service) in Israel and has sent 570 ambulances to save Israeli lives. Mr. Schwartz is retiring this year and he will speak to the students about the immense importance of Magen David Adom for the people of Israel and of ways we can support MDA here and in Israel. The Hebrew Honor Society will take upon itself as a Chesed (community service) project to support the MDA and promote the idea that “all Jews are responsible for each other”.

The Hebrew Honor Society recognizes outstanding achievements in the study of Hebrew language and literature, stimulates study and advancement in this field, and promotes an understanding and appreciation of the culture of Israel. The Hebrew Honor Society members have demonstrated the qualities of diligence, initiative, and commitment to helping others as well as academic excellence. Selection for membership is made by a faculty council based upon student scholarship, character, leadership and service. Member responsibilities are to continue to demonstrate these qualities. To be eligible for selection to membership, the candidate must have completed a minimum of 3 semesters of regular level, high school, Hebrew language and maintained an overall grade of 90 percent or better. Candidates and members must participate in extra curricular activities such as publishing, tutoring, performing, learning activities in Israel, and more. Honorary members may be chosen on the basis of their scholarly distinction or notable contributions to the field of Hebrew culture and literature.
